Request #18-3977

City & County of San Francisco

ATTN:  Mohammed Nuru

RE:      Prime Contractor:       Catmex Maintenance

Project:                        Catmex – Anderson Hill Firework Abatement

Dear Mohammed Nuru:

We are requesting the following information/documentation:

Pursuant to Labor Code Section 1776, please accept this as a formal request for certified payroll records from the above-noted contractor.

Labor Code Section 1776 provides the public with the ability to request and receive certified payroll records from the "body awarding the contract."   In the matter of SB854, DIR states (

“Yes, contractors must provide CPRs to the project owner (awarding body) and all contractors above them.  Once DIR has fully developed and implemented its electronic payroll reporting system, it will be possible to furnish CPRs to all of these entities simultaneously when submitting the records to the Labor Commissioner.”

Additionally, pursuant to Labor Code Section 1776(e), the Foundation for Fair Contracting (FFC) is a joint labor–management committee established pursuant to the Federal Management Cooperation Act of 1978 (Section 175a of Title 29 of the United States Code).  This allows the FFC disclosure of the workers’ names and addresses on the certified payroll records.

As the DIR does not release this confidential information on its web site, the FFC relies on the Awarding Agency, as required by law, to fulfill these requests. Therefore, please provide FFC the payrolls with the workers’ names and addresses left intact.

Please have the contractor provide us a completed fringe benefit statement and a statement of compliance.  Copies of blank reporting forms can be found at our web site:

We are requesting the records for the following period of time:

  • Start of work through December 3, 2018

This is a formal request for information/documentation on the above-referenced project.  This request is being made pursuant to the California Public Records Act, Government Code Section 6250, et seq.

Please send the following information:

  • List of Subcontractors/Subconsultants
  • Notice of Completion Date
  • Copy of Payment and Performance Bond
  • Copy of Signed Contract
  • Inspector’s Daily Logs

If easier, please fax the information/documents to (916) 487-0306 or forward via email address

Thank you for providing the information. We appreciate the time and attention it takes to comply with these requests.  Please call with questions, comments, or clarifications.

This section states "a fee not to exceed 10 cents per page may be charged." Postage is an additional cost.

Please note that the Public Records Act requires an agency to make available to any person a copy of an “identifiable record or records” in its possession, unless the record is specifically exempt from disclosure. (Please see California Government Code § 6253(b).) The City’s obligation under the Sunshine Ordinance, like the Public Records Act, is to produce public records in its custody. (See San Francisco Administration Code § 67.20(b).) There is no requirement that a department or officer construct a document to meet the specifications of the request.

Due to privacy concerns, personal information, such as personal phone numbers, cell numbers and email addresses, has been redacted from the documents that we are making available to you.
